1. Search your trademark

The trademark can be searched both online and offline. The agent would check with the Trademark office, whether the trademark that you have selected of already allotted to any other brands or person. If no similar brand has taken this trademark, then it is unique and you can apply for it.
Now that your name is finalized upon, fill in the trademark application i.e. Form- TM 1. The application costs INR 3500 and is a one time fee.
2. Full in the application form
There are 2 ways to file the registration – manual filing or e-filling.
In this step, you have to fill the application form and your representative will help you in this process also. If the selected trademark is already taken, then you have to change yours else you can use it. You can fill the application form here also. The application form would cost you Rs. 2500. This is a one-time investment. It might take 2-3 days. Your lawyer will also send you the original sheet of the registered trademark that you have applied for.
3. Registration of trademark
In this step, the lawyer would submit your application to the Trademark office. The government fee is Rs. 4500 for startups or small businesses and for others it is 9000. The Trademark Office will then analyze your details and the company details. They will check for any objection in the application. If there is any objection, they will raise it and you will be contacted. If in case everything is good, an ad would be created in the Trademark Journal. There should no objection from other companies also within a period of four months.
After this, your signature trademark is enrolled 6 months afterward. It may take from 18 months to 24 months for the Trademark office to decide, whether you will be given the registered trademark for your brand or not.

Afterward, you just need to renew it.
